Oregon football is set to face Illinois in a Big Ten matchup without Evan Stewart. Meanwhile, the Oregon Ducks wide receiver’s legal situation has taken an unexpected turn ahead of the team’s upcoming game.

Reportedly, prosecutors have declined to file a Driving Under the Influence of Intoxicants (DUII) charge against Stewart.

“Prosecutors have declined to file a Driving Under the Influence of Intoxicants charge against Oregon Ducks star wide receiver Evan Stewart following his arrest in Springfield last weekend,” according to KATU News.

Stewart was arrested on suspicion of driving under the influence of intoxicants in Springfield following the Ducks’ game against Nebraska. He was booked into Springfield Municipal Jail at approximately 7 a.m. and released to a third party about an hour later, according to reports citing police information.

However, OregonLive reporter Ryan Clarke offered a different explanation after speaking with the Springfield Police Department. According to Clarke, prosecutors were still waiting to receive evidence before determining how to proceed with the case.

“Based on my conversation with Springfield PD yesterday, this is inaccurate,” Clarke reported. “Prosecutors are awaiting delivery of evidence, which can sometimes take days or weeks depending on if it was a blood draw, before formally filing charges. That’s why it says “no complaint filed” online.”

Stewart’s legal situation comes amid an injury issue that has already affected his availability. The wide receiver missed Oregon’s 17-14 win over Nebraska.

Before his absence, Stewart had established himself as one of Oregon’s leading offensive contributors. Through five games, he recorded 27 receptions for 352 yards and four touchdowns.

Now, Oregon are set to enter the Illinois game with a 4-2 overall record and a 2-1 mark in Big Ten play. The game is another opportunity for the team to build momentum, but Stewart’s continued absence leaves the team without one of its most productive receivers.
